Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hanakoi AI character companion platform, including the website at hanakoi.com and our mobile applications (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Hanakoi lets you discover, create and chat with AI-generated characters. Characters and their messages are produced by artificial intelligence: everything a character says is fictional and made up. Characters are not real people, do not have genuine feelings or beliefs, and their statements may be inaccurate, inconsistent or invented.

AI-generated replies are not professional advice. Do not rely on them for medical, legal, financial or safety-critical decisions. If you are in crisis, please contact your local emergency services or a crisis hotline — the Service may surface hotline referrals, but it is not a substitute for professional help.

You must be at least 13 years old (or the higher minimum age required by your local law) to use the Service. Before chatting, you must declare your year of birth truthfully. Accounts identified as belonging to minors are subject to additional protections, including periodic reminders that characters are AI-generated, usage break reminders, and disabled image/video generation. Content intended for adults is not accessible to minor accounts.

You are responsible for keeping your credentials confidential and for all activity under your account. You may not share an account or use the Service on behalf of someone who is ineligible.

You agree not to use the Service to create, request or distribute content that:

• sexualises or otherwise harms minors in any way, including fictional or roleplay scenarios;
• promotes violence, self-harm, suicide or dangerous activities;
• harasses, threatens or defames any person;
• is unlawful, fraudulent or infringes the rights of others;
• attempts to bypass, probe or disable our safety systems, moderation, age-gate or other protections;
• interferes with the Service’s operation, including automated scraping or unauthorized access.

All messages and character personas pass through automated content moderation. We may restrict, suspend or terminate accounts that violate these Terms or our safety policies, with or without notice where required to protect users or the Service.

Some features consume credits (for example generating images or extended AI interactions). Credits and their prices are displayed before you spend them. Credit balances are personal to your account, cannot be transferred, and expire as described at purchase time or as required by law.

• Subscriptions are processed through RevenueCat and billed by Apple App Store or Google Play; their payment terms apply to your purchase.
• Auto-renewal is never enabled by default — you must explicitly opt in, and you can cancel at any time in your store account settings before the next billing date.
• Cancellation stops future renewals; access to subscription benefits continues until the end of the paid period.
• Refunds are handled under Apple’s or Google’s refund policies as applicable; Hanakoi does not issue refunds directly for store-billed purchases.

Characters will never ask you to pay, never reference your balance or subscription status, and are barred from any sales talk. All purchase flows are initiated only by you, with the price shown up front.

You retain ownership of the content you create on Hanakoi, such as the messages you write and the characters you design ("User Content"). You grant Hanakoi a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and process User Content solely to operate, secure and moderate the Service. Content you share publicly (for example a published character) may be displayed to other users under features you opt into.

You are responsible for your User Content and must have the rights needed to submit it. We may remove User Content that violates these Terms or our safety policies.

Except for your User Content, all materials on the Service — including the Hanakoi name and logo, interface, software and systems — are owned by Hanakoi or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from them without permission. If you believe content on the Service infringes your rights, contact us at support@hanakoi.com.

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us or others, or where required by law. On termination, your account data is handled as described in the Privacy Policy; provisions that by their nature should survive (including these Terms’ disclaimers and limitations) remain in effect.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your expectations.

To the maximum extent permitted by law, Hanakoi and its affiliates, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from or relating to your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) fifty US dollars (USD 50). Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence or for fraud.

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. The parties will first attempt to resolve disputes informally by contacting support@hanakoi.com. Any remaining dispute shall be brought exclusively in the state or federal courts located in California, unless applicable consumer law grants you the right to bring proceedings in your local courts.

We may update these Terms from time to time. Material changes will be announced in the Service before they take effect, and the "Last updated" date above will always reflect the current version. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
